Terms of Use

These Terms of Use, together with the End-User License Agreement in Section 17, form a binding agreement between you and MediByte. They're written to be read — please take a moment with them, and pay particular attention to the medical disclaimer, the disclaimers of warranties and the limitation of liability.

01 Acceptance of these terms

By downloading, accessing or using the MediByte application and related services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is operated by SOLVAR YAZILIM VE BİLİŞİM LTD. ŞTİ., a limited liability company incorporated under the laws of the Republic of Türkiye ("MediByte", "we", "us" or "our"). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

02 Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service, and old enough to form a binding contract. The Service is intended for medical and health-sciences students and professionals.

03 The MediByte Service

MediByte is an educational platform for medical-exam preparation, including a question bank, lessons, a 3D anatomy atlas, OSCE simulations, flashcards, mock exams, multiplayer features and an AI study tutor. We may add, change or remove features at any time to improve the Service.

04 Your account

You are responsible for safeguarding your login credentials and for all activity under your account. Provide accurate information and keep it current. Do not share your account or use another person's account. Notify us promptly at support@medi-byte.com if you suspect unauthorized use.

05 License & restrictions

Subject to these Terms, MediByte grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Service on a device you own or control, for your own non-commercial study. You agree not to, and not to permit anyone else to:

  • copy, reproduce, scrape, resell, sublicense, rent or redistribute the Service or its content;
  • reverse-engineer, decompile or disassemble any part of the Service, except to the extent the law expressly permits;
  • circumvent, disable or interfere with security, access controls or usage limits;
  • use automated means (bots, scrapers) to access the Service or extract its content; or
  • use the Service to build a competing product or to train a machine-learning model.

06 Subscriptions, billing & auto-renewal

MediByte is free to start. Premium features require a paid subscription, purchased and billed through your Apple App Store account.

  • Auto-renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
  • Managing & cancelling. You can manage or cancel your subscription anytime in your Apple ID account settings. Cancelling stops future renewals; it does not retroactively refund the current period.
  • Prices. Pricing is shown in the app before purchase and may change for future periods with notice.
  • Refunds. Purchases are processed by Apple and are subject to Apple's refund policies; we do not separately process App Store payments or refunds.

07 Acceptable use

When using the Service you agree not to:

  • violate any law, infringe others' rights, or upload unlawful, harmful or infringing content;
  • harass, abuse, impersonate or harm other users, including in multiplayer features;
  • cheat, manipulate rankings, or exploit bugs for unfair advantage;
  • upload malware or attempt to disrupt, overload or gain unauthorized access to the Service; or
  • misrepresent the educational content as clinical guidance to others.

08 User content & feedback

You retain ownership of content you submit (such as notes or feedback). You grant MediByte a worldwide, royalty-free, non-exclusive license to host, store, reproduce and use that content as needed to operate and improve the Service. Any suggestions or feedback you provide may be used by us without obligation or compensation to you. You are responsible for the content you submit and confirm you have the right to submit it.

09 Intellectual property

The Service and all of its content — including the question banks, explanations, lessons, illustrations, the 3D atlas, the "Dr. MediByte" character, the MediByte name and logo, software, and design — are owned by MediByte or its licensors and are protected by intellectual-property laws. Except for the limited license above, these Terms grant you no rights in the Service or its content.

10 Medical disclaimer

MediByte is an educational and exam-preparation tool only. Its content is not medical advice and must never be used to diagnose, treat, or manage any real patient or medical condition.

The Service, including AI-generated explanations, tutoring and patient simulations, is provided for study purposes and may contain errors, simplifications or omissions. Clinical decisions must always rest on qualified supervision, your own professional judgement, and authoritative primary sources. Never disregard professional medical advice or delay seeking it because of something you read in the Service. If you are experiencing a medical emergency, contact your local emergency services.

11 Third-party services

The Service relies on third-party providers (including Apple, Google Firebase and AI providers) and may interoperate with or link to third-party services. We are not responsible for third-party services, and your use of them may be subject to their own terms.

12 Disclaimers of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that defects will be corrected, or that content (including exam-readiness indicators or predicted scores) is accurate, complete or will lead to any particular result on any examination.

13 Limitation of liability

To the maximum extent permitted by law, MediByte and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or examination outcome, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

14 Indemnification

You agree to indemnify and hold harmless MediByte and its personnel from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.

15 Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users. Provisions that by their nature should survive termination (including IP, disclaimers, limitation of liability and governing law) will survive.

16 Governing law & disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, and the courts and execution offices (icra daireleri) of İstanbul, Türkiye will have exclusive jurisdiction over any dispute arising out of or relating to them, except where mandatory consumer-protection law in your country of residence provides otherwise. Nothing in this section deprives you of the protection of mandatory provisions of your local law.

17 Apple App Store — licensed application terms

The following terms apply when you obtain the Service from the Apple App Store. They supplement, and where required prevail over, the rest of these Terms:

  • Acknowledgement. These Terms are between you and MediByte only, not with Apple. Apple is not responsible for the Service or its content.
  • Scope of license. The license granted is limited to a non-transferable license to use the Service on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
  • Maintenance & support. MediByte is solely responsible for providing any maintenance and support for the Service. Apple has no obligation to furnish any maintenance or support.
  • Warranty. MediByte is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the Service.
  • Product claims. MediByte, not Apple, is responsible for addressing any claims relating to the Service, including product-liability, legal-or-regulatory-compliance, and consumer-protection claims.
  • Intellectual-property claims. In the event of any third-party claim that the Service infringes intellectual-property rights, MediByte, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated "terrorist-supporting," and that you are not on any U.S. Government restricted-parties list.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

18 Changes to these terms

We may update these Terms as the Service evolves or the law changes. When changes are material, we will revise the "Last updated" date and, where appropriate, provide notice in the app. Your continued use of the Service after an update means you accept the revised Terms.

19 General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and MediByte regarding the Service.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • Waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
